Terms of Service
1. Accepting these terms
Using the Oh My Notes macOS app, browsing ohmynotes.icocah.com (or related pages on icocah.com), or joining the early-access / waitlist means you agree to these terms. If you do not agree, please do not use the app or the website. Our privacy page explains how data is handled; it is part of how we run the product.
2. Free tier licence
- Oh My Notes is a floating sticky notes app for macOS. The free tier is free to use, forever, for personal use.
- We grant you a personal, non-exclusive, non-transferable licence to install and use the free tier on Macs you own or control.
- Except as expressly permitted by applicable law, you may not reverse engineer, decompile or disassemble the app binaries, and you may not redistribute, sublicense or sell them without our prior written permission.
- Your note files (plain Markdown and related local files) are yours. This licence does not transfer ownership of your content to us.
3. The Pro licence
- Pro is a one-time purchase of US$9.99; waitlist members get the early-bird price of US$7.99. No subscription, and nothing is charged automatically.
- The one-time purchase unlocks Pro features on the buyer’s Mac, as described at the time of purchase. The licence belongs to the buyer; it is not a subscription.
- We may adjust the feature split and new-customer prices as the product evolves; price changes do not affect licences already purchased.
- Checkout will be handled by a payment provider acting as the merchant of record. Card details are handled by that provider; we do not store them.
4. Waitlist / early-access emails
Joining the early-access list is optional. If you sign up, we may email you downloads, product updates and other Oh My Notes news. To be removed, email [email protected] from the address you signed up with. See the privacy page for details.
5. Intellectual property
- The Oh My Notes app, website, name, logo and related materials belong to us or our licensors. These terms do not give you ownership of the software or the brand.
- You keep all rights to content you create, including your notes. We do not claim ownership of your local Markdown files.
6. Acceptable use
- Use the app and the website only for lawful purposes.
- Do not abuse downloads, forms or the website infrastructure (for example automated scraping that harms availability, or attempts to disrupt the service).
- Do not use the product to spread malware or infringe other people’s rights.
7. Third-party services
- This website is hosted on Cloudflare Pages. The host may process standard technical logs as described on the privacy page.
- The waitlist form is handled by Formspree (or a successor form provider) under its own terms and privacy policy.
- Optional sync you choose later (for example iCloud Drive, Dropbox, git or Obsidian) runs only between your Mac and that service, under that service’s terms. Oh My Notes does not operate a notes sync backend.
- Pro payments are handled by a payment provider acting as the merchant of record, under its own terms.
8. Disclaimer
To the maximum extent permitted by law, the app and the website are provided “as is” and “as available”, without warranties of any kind, express or implied. Features and availability may change as the product evolves. We do not promise the software will be uninterrupted, error-free, or fit for any particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or business, arising from use of the app or the website. Our total liability for any claim is limited to the amount you paid us for the product. Some jurisdictions do not allow certain limits; in those cases, liability applies up to the maximum extent the law allows.
10. Refunds
If Pro is not for you, you can request a refund within 14 days of purchase. Final refund terms will be shown at checkout and may be enforced by the payment provider.
11. Changes to these terms
We may update these terms from time to time; when we do, the “Last updated” date at the top changes. Continuing to use the app or the website after an update means you accept the revised terms. For changes that materially affect people who have bought Pro, we will try to give reasonable notice (for example, by emailing the waitlist or purchase contact address we hold, or by posting a notice on this website).
